— ÖZET — 

Ceza hukuku diye bir kavram varken, bir baro dergisinde niçin böyle bir başlık atıldığı merak edilebilir. Suç, dünyanın her yerinde ve tüm toplumlarda var olan, en önemli toplumsal sorunlardan biridir. Suçun hukuksal yönü yanında, çok sayıda sosyal bilimler ve fen bilimleri disiplini, uzun sayılabilecek bir zamandır suç ve ceza konusuyla ilgilenmektedir. Dolayısıyla suç ve ceza bilimleri sadece hukuktan ibaret değildir.

Bu yazının amacı, suç ve ceza bilimlerine genel bir bakış açısı sunmak ve farklı disiplinlerin uğraşı alanına giren konuları karşılaştırmalı olarak ele almaktır. Böylelikle hukukçu olmayanlara ceza hukukunun konusu ve dallarıyla ilgili bir bilgi sunulurken; suç ve ceza ile ilgilenen diğer (hukukun dışındaki) bilim dallarına ise hukukçuların dikkati çekilmek istenmektedir.

Suç ve ceza bilimlerini temel olarak üç kategoride değerlendirmek mümkündür. Bunlardan ilk akla geleni suç/ ceza hukuku ve onun alt dalları; bir toplumsal düzende hangi fiillerin suç olacağı, bunlara hangi cezaların verileceği, cezalandırmanın yargısal süreci ve cezanın infazına ilişkin kuralları inceleme konusu yapar. İkinci kategori, sosyal bilimler grubudur. Başta sosyoloji, psikoloji, antropoloji gibi bilim dalları, genel olarak bir toplumda suç neden vardır, nasıl önlenir, suçlu kimdir ve niçin suç işler sorularını yanıtlamaya çalışır. Üçüncü kategori ise, bir suç işlendikten sonra bu suçun failini ve nasıl işlendiğini ortaya çıkarmaya çalışan fen bilimi disiplinleridir.

— ABSTRACT — 

While there is a term “criminal law” it may be wondered why such a title was used in a bar association magazine. Crime is one of the most critical social problems that exist all over the world and in all societies. In addition to the legal aspect of crime, many social sciences and science disciplines have been dealing with crime and punishment for a long time. Therefore, crime and punishment studies are not just about the law.
This article aims to present an overview of crime and criminal sciences and to comparatively deal with the issues in the field of different disciplines. Thus, while providing information about the subject and branches of criminal law to those who are not lawyers; it is desired to draw the attention of lawyers to other branches of science (other than law) dealing with crime and punishment.
It is possible to evaluate the crime and criminal sciences in three categories. The first thing that comes to mind first is the criminal (penal) law and its sub-branches. It deals with acts as a crime in a social order, which penalties will be given to them, the judicial process of the criminal commit and the rules regarding the execution of the penalty. The second category is the disciplines of the social sciences. Main disciplines such as sociology, psychology, and anthropology, in general, try to answer the questions why there is a crime in a society, how to prevent it, what is criminality and what is the reason of criminality. The third category is the science disciplines that try to reveal the perpetrator of a crime and how it was committed.
